{"id":693,"date":"2024-07-15T14:48:30","date_gmt":"2024-07-15T14:48:30","guid":{"rendered":"https:\/\/www.moore-czech.cz\/?p=693"},"modified":"2026-02-09T14:49:30","modified_gmt":"2026-02-09T14:49:30","slug":"zmeny-v-dpp-a-dpc-mohou-mit-negativni-dopad-na-flexibilitu-zamestnavani-v-cesku","status":"publish","type":"post","link":"https:\/\/www.moore-czech.cz\/en\/zmeny-v-dpp-a-dpc-mohou-mit-negativni-dopad-na-flexibilitu-zamestnavani-v-cesku\/","title":{"rendered":"Zm\u011bny v\u202fDPP a DP\u010c mohou m\u00edt negativn\u00ed dopad na flexibilitu zam\u011bstn\u00e1v\u00e1n\u00ed v \u010cesku\u00a0\u00a0\u00a0"},"content":{"rendered":"<p><strong>Od&nbsp;1. \u010dervence&nbsp;vstoupily&nbsp;v platnost nov\u00e9 zm\u011bny t\u00fdkaj\u00edc\u00ed se dohody o proveden\u00ed pr\u00e1ce (DPP) a dohody o pracovn\u00ed \u010dinnosti (DP\u010c).&nbsp;Mimo zv\u00fd\u0161en\u00ed minim\u00e1ln\u00ed mzdy a roz\u0161\u00ed\u0159en\u00ed pr\u00e1v zam\u011bstnanc\u016f pracuj\u00edc\u00edch na z\u00e1klad\u011b DPP a DP\u010c, nap\u0159\u00edklad v\u202foblasti dovolen\u00e9 a zam\u011bstnaneck\u00fdch v\u00fdhod,&nbsp;p\u0159in\u00e1\u0161\u00ed&nbsp;v\u00fdznamnou&nbsp;zm\u011bnu&nbsp;v podob\u011b&nbsp;povinnosti&nbsp;zam\u011bstnavatele&nbsp;ozn\u00e1mit&nbsp;ka\u017ed\u00fd m\u011bs\u00edc DPP na \u010cSSZ.&nbsp;Tato povinnost&nbsp;bude m\u00edt na administrativu firem v\u00fdrazn\u00fd dopad.<\/strong>&nbsp;<\/p>\n\n\n\n<p>Oznamovac\u00ed povinnost&nbsp;se&nbsp;t\u00fdk\u00e1&nbsp;v\u0161ech DPP, v\u010detn\u011b t\u011bch s p\u0159\u00edjmem do 10 000 K\u010d, kter\u00e9 nejsou \u00fa\u010dastny na pojistn\u00e9m.&nbsp;Zam\u011bstnavatel&nbsp;mus\u00ed&nbsp;DPP ozn\u00e1mit na \u010cSSZ&nbsp;do 20. dne n\u00e1sleduj\u00edc\u00edho m\u011bs\u00edce.&nbsp;Sou\u010dasn\u011b&nbsp;mus\u00ed&nbsp;tak\u00e9 ohla\u0161ovat n\u00e1stup i skon\u010den\u00ed zam\u011bstn\u00e1n\u00ed, a to&nbsp;na p\u0159edepsan\u00e9m tiskopisu V\u00fdkazu DPP spolu s p\u0159\u00edjmy.&nbsp;Samotn\u00fd re\u017eim&nbsp;DPP se&nbsp;p\u0159itom&nbsp;od 1.&nbsp;\u010dervence&nbsp;2024&nbsp;nezm\u011bnil, limit 10 000 K\u010d&nbsp;z\u016fstal&nbsp;zachov\u00e1n&nbsp;i nad\u00e1le.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Na prvn\u00ed pohled&nbsp;nev\u00fdrazn\u00e1&nbsp;zm\u011bna&nbsp;v\u202foznamovac\u00ed povinnosti&nbsp;v\u0161ak bude m\u00edt&nbsp;na firmy&nbsp;siln\u00fd&nbsp;dopad, zejm\u00e9na pokud jde o zv\u00fd\u0161en\u00ed n\u00e1klad\u016f na administrativu a \u010dasovou n\u00e1ro\u010dnost.&nbsp;<em>\u201eO\u010dek\u00e1v\u00e1m, \u017ee&nbsp;ve firm\u00e1ch citeln\u011b naroste \u010das, kter\u00fd str\u00e1v\u00ed&nbsp;evidenc\u00ed&nbsp;a zpracov\u00e1n\u00edm&nbsp;m\u011bs\u00ed\u010dn\u00edch zm\u011bn&nbsp;v\u202fr\u00e1mci oznamovac\u00ed povinnosti. Firmy budou muset investovat do \u00fapravy st\u00e1vaj\u00edc\u00edch \u010di po\u0159\u00edzen\u00ed nov\u00fdch syst\u00e9m\u016f a pat\u0159i\u010dn\u011b za\u0161kolit sv\u00e9 zam\u011bstnance, aby zajistily v\u010dasn\u00e9 a spr\u00e1vn\u00e9 hl\u00e1\u0161en\u00ed v\u0161ech dohod o proveden\u00ed pr\u00e1ce. Jin\u00fdmi slovy tento nov\u00fd po\u017eadavek na m\u011bs\u00ed\u010dn\u00ed ohla\u0161ov\u00e1n\u00ed p\u0159id\u00e1 dal\u0161\u00ed administrativn\u00ed vrstvu, co\u017e povede k n\u00e1r\u016fstu n\u00e1klad\u016f na person\u00e1ln\u00ed odd\u011blen\u00ed a zv\u00fd\u0161en\u00ed pracovn\u00ed z\u00e1t\u011b\u017ee pro administrativn\u00ed pracovn\u00edky,\u201c<\/em>&nbsp;\u0159\u00edk\u00e1&nbsp;Marcela Hrd\u00e1, partnerka&nbsp;Moore&nbsp;Czech Republic.&nbsp;<\/p>\n\n\n\n<p><strong>\u00damysl dobr\u00fd,&nbsp;proveden\u00ed v\u202fpraxi je v\u0161ak nejist\u00e9<\/strong>&nbsp;<\/p>\n\n\n\n<p>P\u016fvodn\u011b mo\u017en\u00e1 dob\u0159e zam\u00fd\u0161len\u00e9 zm\u011bny tak budou z\u0159ejm\u011b m\u00edt&nbsp;negativn\u00ed dopad na flexibilitu zam\u011bstn\u00e1v\u00e1n\u00ed v \u010cesk\u00e9 republice, zejm\u00e9na pokud jde o zam\u011bstn\u00e1v\u00e1n\u00ed formou dohody o proveden\u00ed pr\u00e1ce.&nbsp;<em>\u201ePovinnost m\u011bs\u00ed\u010dn\u00edho hl\u00e1\u0161en\u00ed v\u0161ech dohod o proveden\u00ed pr\u00e1ce na \u010cSSZ&nbsp;zv\u00fd\u0161\u00ed&nbsp;administrativn\u00ed z\u00e1t\u011b\u017e pro zam\u011bstnavatele, co\u017e&nbsp;m\u016f\u017ee v\u00e9st k tomu, \u017ee n\u011bkte\u0159\u00ed zam\u011bstnavatel\u00e9 budou m\u00e9n\u011b ochotni vyu\u017e\u00edvat tuto formu zam\u011bstn\u00e1n\u00ed. Dodate\u010dn\u00e1 administrativa a n\u00e1klady spojen\u00e9 s evidenc\u00ed a zpracov\u00e1n\u00edm m\u011bs\u00ed\u010dn\u00edch zm\u011bn mohou odradit firmy od vyu\u017e\u00edv\u00e1n\u00ed dohod o proveden\u00ed pr\u00e1ce pro kr\u00e1tkodob\u00e9 a do\u010dasn\u00e9 \u00fakoly. Tak ale nebudou schopn\u00e9&nbsp;rychle a efektivn\u011b reagovat na m\u011bn\u00edc\u00ed se pot\u0159eby trhu,\u201c&nbsp;<\/em>vysv\u011btluje&nbsp;Michal \u0160est\u00e1k, da\u0148ov\u00fd poradce&nbsp;Moore&nbsp;Accounting&nbsp;CZ.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Sn\u00ed\u017een\u00ed celkov\u00e9 flexibility pracovn\u00edho trhu&nbsp;p\u0159itom&nbsp;m\u016f\u017ee m\u00edt \u0161ir\u0161\u00ed dopady na dynamiku zam\u011bstn\u00e1v\u00e1n\u00ed v \u010cesk\u00e9 republice.&nbsp;Firmy budou muset p\u0159ehodnotit sv\u00e9 strategie v oblasti n\u00e1boru a \u0159\u00edzen\u00ed pracovn\u00edch sil, aby se p\u0159izp\u016fsobily nov\u00fdm legislativn\u00edm po\u017eadavk\u016fm a minimalizovaly dodate\u010dn\u00e9 administrativn\u00ed n\u00e1klady. To v\u0161ak m\u016f\u017ee&nbsp;v\u00e9st k tomu, \u017ee za\u010dnou hledat alternativy k dohod\u00e1m o proveden\u00ed pr\u00e1ce a dohod\u00e1m o pracovn\u00ed \u010dinnosti.&nbsp;Mohou nap\u0159\u00edklad zv\u00fd\u0161it svou preferenci pro uzav\u00edr\u00e1n\u00ed hlavn\u00edch pracovn\u00edch pom\u011br\u016f,&nbsp;nebo naopak v\u00edce tla\u010dit na vyu\u017e\u00edv\u00e1n\u00ed extern\u00ed spolupr\u00e1ce v\u202fpodob\u011b smluv s\u202fOSV\u010c.&nbsp;<\/p>\n\n\n\n<p><em>\u201eMotivace vl\u00e1dy k\u202fzaveden\u00ed zm\u011bn je jasn\u00e1. Pokud firmy p\u0159ijmou nov\u00e9 povinnosti a budou d\u016fsledn\u011b hl\u00e1sit v\u0161echny dohody, m\u011blo by to v\u00e9st ke zv\u00fd\u0161en\u00ed transparentnosti a zlep\u0161en\u00ed podm\u00ednek pro zam\u011bstnance.&nbsp;Vzhledem k demografick\u00e9mu v\u00fdvoji v \u010cesk\u00e9 republice a rychle se m\u011bn\u00edc\u00edmu pracovn\u00edmu trhu d\u00edky zdokonalov\u00e1n\u00ed technologi\u00ed bych&nbsp;v\u0161ak&nbsp;r\u00e1da&nbsp;vid\u011bla&nbsp;i&nbsp;v\u011bt\u0161\u00ed podporu flexibiln\u00edch pracovn\u00edch \u00favazk\u016f. Mysl\u00edm si, \u017ee to je t\u00e9ma, kter\u00e9 by si z\u202flegislativn\u00edho hlediska zaslou\u017eilo pozornost,\u201c&nbsp;<\/em>dod\u00e1v\u00e1&nbsp;Marcela Hrd\u00e1.&nbsp;<\/p>\n\n\n\n<p><strong>Mo\u017enost\u00ed, jak zv\u00fd\u0161it flexibilitu pracovn\u00edho trhu, je mnoho<\/strong>&nbsp;<\/p>\n\n\n\n<p>A\u010dkoliv si \u010cesk\u00e1 republika v porovn\u00e1n\u00ed s ostatn\u00edmi st\u00e1ty EU stoj\u00ed v oblasti flexibility pracovn\u00edho trhu relativn\u011b dob\u0159e, st\u00e1le existuj\u00ed oblasti, kde je prostor pro zlep\u0161en\u00ed. V n\u011bkter\u00fdch zem\u00edch EU, nap\u0159\u00edklad v Nizozemsku nebo D\u00e1nsku, je flexibilita pracovn\u00edho trhu vy\u0161\u0161\u00ed d\u00edky l\u00e9pe nastaven\u00fdm pr\u00e1vn\u00edm a administrativn\u00edm r\u00e1mc\u016fm, kter\u00e9 podporuj\u00ed r\u016fzn\u00e9 formy zam\u011bstn\u00e1v\u00e1n\u00ed, jako jsou zkr\u00e1cen\u00e9 \u00favazky&nbsp;a pr\u00e1ci na d\u00e1lku.&nbsp;Zm\u011bnu k&nbsp;flexibiln\u011bj\u0161\u00edmu pracovn\u00edmu prost\u0159ed\u00ed&nbsp;si vy\u017e\u00e1dala jak pandemie covid-19, tak i n\u00e1stup generace Z\u202fdo zam\u011bstn\u00e1n\u00ed.&nbsp;&nbsp;<\/p>\n\n\n\n<p><em>\u201eA\u010dkoliv jsou zam\u011bstnavatel\u00e9 o n\u011bco ochotn\u011bj\u0161\u00ed nab\u00edzet zkr\u00e1cen\u00e9 \u00favazky, ne\u017e tomu bylo d\u0159\u00edve,&nbsp;\u010cesko ani zdaleka nedosahuje unijn\u00edho pr\u016fm\u011bru. Zat\u00edmco&nbsp;u n\u00e1s&nbsp;tvo\u0159\u00ed&nbsp;zkr\u00e1cen\u00e9 \u00favazky 6 %, pr\u016fm\u011br v\u202fEU&nbsp;vych\u00e1z\u00ed na 13,7 %. P\u0159\u00edkladem pak m\u016f\u017ee b\u00fdt Nizozemsko, kde zkr\u00e1cen\u00e9 \u00favazky&nbsp;tvo\u0159\u00ed&nbsp;dokonce&nbsp;42,6 % v\u0161ech pracovn\u00edch pom\u011br\u016f<\/em><em><sup>1<\/sup><\/em><em>,\u201c&nbsp;<\/em>popisuje&nbsp;Aneta&nbsp;Marti\u0161kov\u00e1, \u010dlenka veden\u00ed spole\u010dnosti Edenred.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Ty by p\u0159itom mohly b\u00fdt \u0159e\u0161en\u00edm i&nbsp;pro&nbsp;matky.<em>&nbsp;<\/em>\u201e<em>M\u00edra zam\u011bstnanosti&nbsp;matek&nbsp;ve v\u011bku 20-49 let s jedn\u00edm d\u00edt\u011btem do 6 let je v \u010cesku 39 %, zat\u00edmco v EU je to 70 %.<\/em>\u202f<em>Pandemie covid-19 nav\u00edc uk\u00e1zala, \u017ee \u017eivotaschopnou alternativou k tradi\u010dn\u00edm form\u00e1m zam\u011bstn\u00e1n\u00ed&nbsp;je i pr\u00e1ce na d\u00e1lku.&nbsp;Jak vyplynulo z&nbsp;pr\u016fzkumu&nbsp;Recruitment&nbsp;Academy&nbsp;a spole\u010dnosti Edenred<\/em><em><sup>2<\/sup><\/em><em>, pracovat z domova nyn\u00ed umo\u017e\u0148uje zam\u011bstnanc\u016fm 9 z 10 firem, v\u00fdrazn\u011b se v\u0161ak&nbsp;li\u0161\u00ed&nbsp;podm\u00ednky, za kter\u00fdch tento benefit poskytuj\u00ed. T\u0159i a v\u00edc dn\u016f v t\u00fddnu&nbsp;jich&nbsp;umo\u017e\u0148uje zam\u011bstnanc\u016fm z domova pracovat&nbsp;jen&nbsp;19,5&nbsp;%,\u201c<\/em>&nbsp;dod\u00e1v\u00e1&nbsp;Aneta Marti\u0161kov\u00e1.&nbsp;<\/p>\n\n\n\n<p>Dal\u0161\u00ed mo\u017enosti, jak pomoci zv\u00fd\u0161it flexibilitu \u010desk\u00e9ho pracovn\u00edho trhu,&nbsp;vyplynuly i z\u202fv\u00fdzkumu&nbsp;Moore&nbsp;Czech Republic, kter\u00fd se zam\u011b\u0159il na zam\u011bstn\u00e1v\u00e1n\u00ed osob star\u0161\u00edch 55 let.
